Terms of Service

These Terms of Service ("Terms") govern your use of Sunwise at sunwise.org.au and related services, including the optional free account, sun-session tracker and Model Context Protocol (MCP) endpoints. By using Sunwise you agree to these Terms. Last updated 23 August 2026.
1. Who we are
Sunwise is a free consumer web app operated from Australia at sunwise.org.au ("Sunwise", "we", "us"). For questions about these Terms, email adrian@martini.studio.
2. What Sunwise is (and is not)
Sunwise estimates Fitzpatrick skin type from a photo sample, reads live UV forecasts for a location, and turns those inputs into educational time-before-burning estimates and sun-protection guidance. Signed-in users can also log sun sessions and view personal exposure history.
- Sunwise is not a medical device, clinical tool or diagnostic service.
- Sunwise does not provide medical advice, diagnosis or treatment.
- Estimates can be wrong. Camera colour, lighting, reflection from water or sand, altitude, medications, individual skin variation and many other factors mean real skin can burn sooner than any figure we show.
- There is no safe way to tan. Any tan is a sign of skin damage. Health authorities recommend against deliberate tanning. Burn-time and related figures are shown to help you limit UV exposure, not encourage it.
- Always follow Australian health-authority guidance (including Slip, Slop, Slap, Seek, Slide) and your doctor. If you notice changing moles or unusual skin marks, see a doctor.
3. Eligibility and acceptable use
You may use Sunwise if you can form a binding contract under applicable law. If you use Sunwise on behalf of someone else (for example a child), you are responsible for that use.
You agree not to:
- Use Sunwise for unlawful purposes, or in a way that harms others or interferes with the service.
- Attempt to reverse-engineer, scrape at abusive volumes, overload, or disrupt our APIs, MCP endpoints or infrastructure.
- Misrepresent Sunwise outputs as medical advice, clinical results or a guarantee of safety in the sun.
- Use the service to promote deliberate tanning or unsafe UV exposure.
- Bypass authentication, consent or rate limits, or access another person's account or data without permission.
- Upload or transmit malware, or content you do not have the right to use.
4. Accounts and sign-in
Accounts are optional and free. Sign-in is passwordless: we email a one-time code to the address you provide. You are responsible for keeping access to that email secure and for activity under your account.
When you create an account we may store your email address, Fitzpatrick skin type (if you save one), sun-session history and related profile data. Anonymous activity on the device may be associated with your account when you sign in — see our Privacy Policy.
We may suspend or close accounts that breach these Terms, abuse the service, or put other users or the platform at risk.
5. Photos, camera and location
- Photos / camera: for the skin check, your browser samples a small patch of pixels (typically from the inner upper arm). Those pixels are sent to our servers, analysed in memory and discarded — we do not store the photo or the pixel buffer.
- Location: with your permission, we use your device location (or a place you choose) to fetch UV and weather. Coordinates we keep for analytics are rounded to about one kilometre.
- Browser and OS permission prompts remain under your control. First-party cookies may remember that you allowed camera or location in our UI so we do not re-ask every visit.
6. Sun-session tracker
The sun-session tracker (including the compact widget on UV pages and the full experience at /sun-session) is available to signed-in users. The active session may live on your device (for example in local storage) and finished sessions may be saved to your account. Dose figures reuse the same educational burn model as the rest of Sunwise. Reminders are in-app only; we do not promise push notifications.
7. MCP and AI assistants
Sunwise offers Model Context Protocol endpoints so compatible AI assistants can call the same educational tools. The public endpoint does not require an account. The signed-in endpoint uses OAuth: you approve what an assistant may do on the consent screen. You can deny access and disconnect assistants later from your assistant's settings. You remain responsible for how you and any connected assistant use Sunwise outputs. More detail: /mcp.
8. Third-party services and data sources
Sunwise relies on third parties, including UV and weather forecasts (Open-Meteo), reverse geocoding, email delivery, hosting, analytics and authentication infrastructure. Their availability and accuracy are outside our full control. Third-party sites linked from Sunwise (for example Cancer Council or SunSmart) have their own terms and privacy practices.
9. Intellectual property
Sunwise, including its design, text, logos, software and branding, is owned by us or our licensors. You may use the public site and documented APIs/MCP tools for personal, non-commercial educational purposes in line with these Terms. You may not copy, sell, rebrand or redistribute the service or substantial parts of its content without our written permission, except where Australian law allows (for example fair dealing).
10. No warranties
Sunwise is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties — express or implied — including accuracy, fitness for a particular purpose, non-infringement and uninterrupted availability. UV forecasts, skin-type estimates, burn times and session budgets are approximations only.
11. Limitation of liability
To the fullest extent permitted by law, Sunwise and its operators are not liable for any loss, injury, sunburn, skin damage, illness or other claim arising from your use of (or inability to use) the service, reliance on any estimate or guidance, or decisions you make about sun exposure.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or other laws that cannot be excluded. Where liability cannot be excluded but can be limited, our liability is limited to re-supplying the services or paying the cost of re-supply.
12. Indemnity
You agree to indemnify us against claims, losses and expenses (including reasonable legal fees) arising from your misuse of Sunwise, your breach of these Terms, or your use of MCP / AI assistants in connection with your account — except to the extent caused by our negligence or breach of non-excludable law.
13. Changes, suspension and termination
We may update these Terms, change features, or suspend or discontinue all or part of Sunwise at any time. Material changes will be reflected by updating the date at the top of this page. Continued use after changes means you accept the updated Terms. You may stop using Sunwise at any time; for account deletion requests see the Privacy Policy.
14. Governing law
These Terms are governed by the laws of New South Wales, Australia. Courts in that jurisdiction have non-exclusive jurisdiction, without limiting any rights you have as a consumer in your place of residence.
